By accessing or using our website, application, or any services provided by iJen (collectively, the "Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service.
These Terms constitute a legally binding agreement between you and iJen. Your use of the Service in any manner - including but not limited to visiting the website, registering an account, inputting business data, generating strategies, or making purchases - signifies your acceptance of these Terms and your agreement to comply with and be bound by them.
You represent and warrant that you have the legal capacity and authority to enter into these Terms. If you are using the Service on behalf of a business, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" refer to that entity.
iJen is an AI-powered marketing strategy generation platform. Users provide business details - including but not limited to business name, industry, target audience, competitor information, and marketing goals - and the Service uses artificial intelligence technologies, automated research tools, and data synthesis processes to generate marketing strategy documents ("Generated Content" or "Strategies").
The Service may include, without limitation: ideal customer avatar creation, brand positioning analysis, competitor intelligence reports, marketing funnel design, content system plans, social media strategies, advertising blueprints, email marketing plans, executive briefs, and implementation roadmaps.

All Generated Content is produced by artificial intelligence systems and automated processes. The outputs are informational and educational in nature and are intended solely as a starting point for your own independent evaluation and decision-making.

All marketing strategies, reports, analyses, recommendations, plans, and other content generated by iJen ("Generated Content") are produced by artificial intelligence systems, including but not limited to large language models and automated research tools. You acknowledge and agree to ALL of the following:
5.1 No Guarantee of Accuracy. Generated Content may contain errors, inaccuracies, outdated information, omissions, hallucinated data points, fabricated statistics, incorrect attributions, or other factual mistakes. AI systems can and do produce outputs that appear plausible but are partially or entirely incorrect. iJen makes no representation or warranty whatsoever regarding the accuracy, reliability, completeness, timeliness, or correctness of any Generated Content.
5.2 No Guarantee of Results. iJen makes absolutely no guarantee, promise, or representation that implementing any strategy, recommendation, plan, or suggestion contained in Generated Content will result in any particular business outcome, including but not limited to increased revenue, customer acquisition, brand awareness, website traffic, social media engagement, conversion rates, return on investment, or any other metric of business success. Past performance of any strategy - whether generated by iJen or otherwise - is not indicative of future results.
5.3 Not Professional Advice. Generated Content does not constitute professional marketing advice, business consulting, legal advice, financial advice, or any other form of professional counsel. iJen is not a licensed marketing agency, consulting firm, or professional advisory service. You should consult with qualified professionals before making significant business decisions based on any information provided by the Service.
5.4 User Responsibility. You are solely and exclusively responsible for evaluating, validating, and independently verifying all Generated Content before relying on it or implementing any recommendations. You are solely responsible for any and all business decisions you make, actions you take, or strategies you implement based on - whether in whole or in part - any Generated Content. iJen bears no responsibility whatsoever for the consequences of your use of or reliance on Generated Content.
5.5 AI Limitations. You acknowledge that AI technology has inherent limitations, including but not limited to: potential for bias in training data, inability to account for nuanced or rapidly changing market conditions, lack of human judgment and contextual understanding, potential for generating content that may be similar to content generated for other users, and the possibility of producing outputs that do not accurately reflect your specific business circumstances.
5.6 "As Is" Delivery. All Generated Content is provided strictly on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express, implied, statutory, or otherwise. iJen expressly disclaims all warranties with respect to Generated Content, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and completeness.
5.7 No Fiduciary Duty. Nothing in the Service or these Terms creates a fiduciary, advisory, agency, partnership, joint venture, or employer-employee relationship between you and iJen. iJen owes you no duty of care beyond providing the Service in accordance with these Terms.
6.1 Your Input Data. You retain all ownership rights to the business information, data, and other materials you provide to the Service ("User Inputs"). By submitting User Inputs, you grant iJen a non-exclusive, worldwide, royalty-free license to use, process, store, and transmit your User Inputs solely for the purpose of providing the Service to you and as otherwise described in our Privacy Policy.
6.2 Generated Content License. Subject to your compliance with these Terms and any applicable payment obligations, iJen grants you a non-exclusive, worldwide, perpetual license to use, copy, modify, and distribute Generated Content for your own business purposes. This license does not include the right to use Generated Content to create, operate, or contribute to a service that competes with iJen.
6.3 iJen Platform Rights. iJen and its licensors retain all right, title, and interest in and to the Service, including but not limited to all software, algorithms, prompts, templates, methodologies, user interface designs, trade secrets, trademarks, service marks, logos, and other intellectual property. Nothing in these Terms grants you any right, title, or interest in the Service itself, except for the limited right to use the Service in accordance with these Terms.
6.4 Aggregated and Anonymized Data. iJen may collect, use, and disclose aggregated and anonymized data derived from your use of the Service for any lawful purpose, including but not limited to improving the Service, conducting research, generating benchmarks, and creating industry reports. Such aggregated and anonymized data will not identify you or your business individually.
6.5 Feedback. If you provide any feedback, suggestions, ideas, or recommendations regarding the Service ("Feedback"), you hereby assign to iJen all right, title, and interest in such Feedback, and iJen may use Feedback for any purpose without any obligation or compensation to you.
6.6 No Exclusivity. You acknowledge that Generated Content is produced by AI systems that may generate similar or identical content for other users who provide similar inputs. iJen does not guarantee that Generated Content will be unique to you, and iJen has no obligation to provide exclusive outputs.
7.1 Pricing. iJen offers a Complete Marketing Strategy for a one-time payment of $97 USD (or such other price as may be displayed at the time of purchase). Pricing is subject to change at any time at iJen's sole discretion, provided that price changes will not affect purchases already completed.
7.2 Payment Processing. All payments are processed securely through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy in addition to these Terms. iJen does not store your full credit card number or payment credentials on its servers.
7.3 Taxes. All prices are exclusive of applicable taxes unless otherwise stated. You are responsible for paying all applicable taxes, duties, and levies associated with your purchase.
7.4 Refund Policy. Due to the nature of AI-generated content and the immediate incurrence of significant computational and third-party API costs upon strategy generation, all sales are final once strategy generation has begun (i.e., once the generation process has been initiated and is in "processing" or "completed" status). No refunds, credits, or chargebacks will be issued for strategies that have entered the generation pipeline. If a generation fails due to a technical error on iJen's side and cannot be completed, iJen will, at its sole discretion, either re-attempt the generation at no additional cost or issue a refund.
7.5 Chargebacks. If you initiate a chargeback or payment dispute for a completed strategy generation, iJen reserves the right to immediately suspend or terminate your account, revoke access to all Generated Content, and pursue all available legal remedies to recover the disputed amount plus any associated fees and costs.
7.6 Currency. All prices are listed in United States Dollars (USD). If you are paying from outside the United States, your financial institution may charge additional currency conversion fees, for which iJen is not responsible.
iJen may offer a Free Preview tier that provides access to a limited portion of the strategy generation service (currently limited to Phase 1 - Ideal Customer Avatar only). The Free Preview is provided at no cost and is subject to the following conditions:
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS IJEN'S LIABILITY TO YOU.
9.1 Cap on Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IJEN'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, OR ANY GENERATED CONTENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE ACTUALLY PAID TO IJEN IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100 USD).
9.2 Exclusion of Consequential Damages. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IJEN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF CUSTOMERS, LOSS OF GOODWILL, LOSS OF DATA, LOSS OF USE, BUSINESS INTERRUPTION, COST OF PROCUREMENT OF SUBSTITUTE SERVICES, OR ANY OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND REGARDLESS OF WHETHER IJEN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.3 No Liability for Business Decisions. IJEN SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY BUSINESS DECISIONS YOU MAKE, ACTIONS YOU TAKE, STRATEGIES YOU IMPLEMENT, MARKETING CAMPAIGNS YOU LAUNCH, EXPENDITURES YOU INCUR, OR ANY OTHER CONDUCT THAT IS BASED - IN WHOLE OR IN PART - ON GENERATED CONTENT, RECOMMENDATIONS, OR ANY OTHER INFORMATION PROVIDED BY THE SERVICE. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF AND RELIANCE ON GENERATED CONTENT.
9.4 No Liability for Third-Party Services. IJEN SHALL NOT BE LIABLE FOR ANY OUTAGES, ERRORS, FAILURES, DELAYS, OR INTERRUPTIONS CAUSED BY THIRD-PARTY SERVICE PROVIDERS, INCLUDING BUT NOT LIMITED TO AI MODEL PROVIDERS, PAYMENT PROCESSORS, HOSTING PROVIDERS, AUTHENTICATION SERVICES, RESEARCH API PROVIDERS, OR ANY OTHER THIRD-PARTY TOOLS OR SERVICES USED IN THE OPERATION OF THE SERVICE.
9.5 No Liability for Data Loss. WHILE IJEN TAKES REASONABLE MEASURES TO PROTECT YOUR DATA, IJEN SHALL NOT BE LIABLE FOR ANY LOSS, CORRUPTION, OR UNAUTHORIZED ACCESS TO YOUR DATA BEYOND COMMERCIALLY REASONABLE BACKUP AND SECURITY PRACTICES. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF ANY GENERATED CONTENT OR DATA THAT IS IMPORTANT TO YOU.
9.6 Essential Basis of the Bargain. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND IJEN, AND THAT IJEN WOULD NOT PROVIDE THE SERVICE TO YOU WITHOUT THESE LIMITATIONS. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING THE FAILURE OF THE ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
9.7 Jurisdictional Limitations. Some jurisdictions do not allow the exclusion or limitation of certain damages. If you reside in such a jurisdiction, some or all of the above exclusions or limitations may not apply to you, and you may have additional rights. In such cases, iJen's liability shall be limited to the fullest extent permitted by the applicable law of such jurisdiction.
THE SERVICE, INCLUDING ALL GENERATED CONTENT, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IJEN EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
No advice or information, whether oral or written, obtained by you from iJen or through the Service shall create any warranty not expressly stated in these Terms. You acknowledge that you use the Service and rely on Generated Content entirely at your own risk.
You agree to indemnify, defend, and hold harmless iJen and its officers, directors, employees, agents, affiliates, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:
iJen reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate fully with our defense of such claims. You shall not settle any claim without iJen's prior written consent.
12.1 Termination by iJen. iJen may, at its sole discretion and without prior notice, suspend, restrict, or terminate your account and access to the Service for any reason, including but not limited to: violation of these Terms, suspected fraudulent or abusive activity, failure to pay, extended period of inactivity, or if we reasonably believe that your continued use of the Service may expose iJen to liability.
12.2 Termination by You. You may delete your account at any time by contacting us at support@ijen.ai or through the account settings within the Service. Termination of your account does not entitle you to any refund of any amounts previously paid.
12.3 Effect of Termination. Upon termination of your account, for any reason: (a) your right to access and use the Service will immediately cease; (b) iJen may delete your account data, User Inputs, and Generated Content after a reasonable retention period (typically 30 days), unless retention is required by law; (c) any licenses granted to you under these Terms with respect to Generated Content that was fully paid for prior to termination shall survive termination; and (d) all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 5, 6, 9, 10, 11, 15, and 17.
12.4 Data Export. Prior to terminating your account, you are responsible for downloading and saving any Generated Content or data you wish to retain. iJen is not obligated to maintain or provide copies of your data after account termination.
In addition to the obligations set forth in Section 4, you expressly agree NOT to engage in any of the following prohibited activities:
Violation of any of these prohibited uses may result in immediate termination of your account, forfeiture of any unused services, and may subject you to legal liability.
The Service utilizes and integrates with various third-party services, tools, and platforms to deliver its functionality. These include, without limitation: Supabase (authentication and database), Stripe (payment processing), Google (OAuth authentication), Anthropic (AI language model), Perplexity (research), Vercel (hosting), and Resend (email delivery).
You acknowledge and agree that:
15.1 Governing Law. These Terms and any dispute arising out of or relating to these Terms, the Service, or any Generated Content shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles.
15.2 Informal Resolution. Before initiating any formal dispute resolution proceedings, you agree to first contact iJen at support@ijen.ai and attempt to resolve the dispute informally. The parties shall use good faith efforts to resolve any dispute within thirty (30) days of receipt of a written notice of the dispute.
15.3 Binding Arbitration. If the dispute cannot be resolved informally within thirty (30) days, you and iJen agree that any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be finally settled by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator, and the arbitration proceedings shall take place in Wilmington, Delaware, or, at iJen's discretion, remotely via videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
15.4 Class Action Waiver. YOU AND IJEN AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR CONSOLIDATED ACTION OR PROCEEDING. UNLESS BOTH YOU AND IJEN AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
15.5 Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Additionally, claims within the jurisdiction of a small claims court may be filed in such court.
15.6 Time Limitation. You agree that any claim or cause of action arising out of or related to your use of the Service or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
iJen reserves the right to modify, amend, or update these Terms at any time, at its sole discretion. When we make material changes, we will update the "Last Updated" date at the top of this page and, where practicable, provide notice through the Service interface or via email to the address associated with your account.
Your continued use of the Service after any modifications to these Terms constitutes your binding acceptance of such modifications. If you do not agree to the modified Terms, your sole remedy is to discontinue your use of the Service and delete your account.
It is your responsibility to review these Terms periodically for changes. We recommend reviewing the Terms each time you use the Service.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
These Terms, together with the Privacy Policy (available at ijen.ai/privacy) and any other legal notices or policies published by iJen on the Service, constitute the entire agreement between you and iJen regarding your use of the Service, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. iJen's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
